# RESOLUTION NO. 24-22

**Regarding the Water Authority of Dickson County's application for a National Pollutant Discharge Elimination System permit with the Tennessee Department of Environment and Conservation**

WHEREAS, on December 3, 2021, the Water Authority of Dickson County (WADC) did submit an application with the Tennessee Department of Environment and Conservation (TDEC) for a National Pollutant Discharge Elimination System (NPDES) permit; and

WHEREAS, the WADC application was identified as number TN0082376, titled East Hickman Water Reclamation Facility by TDEC; and

WHEREAS, the WADC did submit in conjunction with the application for a NPDES permit a Preliminary Engineering Report (PER) dated December 2021 and other documents related to the application; and

WHEREAS, upon review of the NPDES permit application and associated PER, TDEC proposed to deny the application with the basis for this denial being set forth in the Rationale document dated April 5, 2023; and

WHEREAS, upon further review and feedback from numerous stakeholders, TDEC denied the application on December 21, 2023.

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Hickman County, Tennessee, meeting in regular session this 23rd day of September, 2024 that:

**Section 1.** The Board of County Commissioners of Hickman County, Tennessee, support and concur with the denial of the permit for NPDES application number TN0082376, based upon the Rationale document submitted by TDEC as well as other related issues and factors.

**Section 2.** The County Mayor is hereby authorized and directed to ensure that the context and content of this resolution be transmitted to all appropriate authorities using the methods the Mayor deems necessary.

**Section 3.** The provisions of this Resolution shall become effective upon its passage, the public welfare requiring it.
