WHEREAS, such plan provides for amendments thereto; and

WHEREAS, the Hickman County Planning Commission, met in regular session on May 7th, 2024, voted to recommend these changes to Hickman County Zoning Resolution;

WHEREAS, the required Public Hearing on this request has taken place, and the Board of County Commissioners of Hickman County, Tennessee, are desirous of approving it;

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Hickman County, Tennessee, assembled in regular session this 28th day of May 2024, that:

SECTION 1. Subsection E. 11 of Section 3.110 of the Zoning Resolution of Hickman County shall be amended by deleting the entirety of the existing subsection and substituting therefor the following new subsection E. 11:

"All mobile home parks existing at the date of the passage of this resolution (July 18, 2005) which do not conform to the provisions of the zoning resolution, shall be governed in accordance with the provisions of this resolution. Under Section 5.020, Nonconforming Uses, the owner of a "grandfathered" mobile home park containing single wide mobile homes may, with the written approval of the Board of Zoning Appeals, and subject to such conditions as the Board of Zoning Appeals may require in order to protect the area, replace the single wide mobile homes with site-built homes having approximately the same footprint and other dimensions, but no additional bedrooms."

SECTION 2. If any section, subsection, sentence, clause, or phrase of this resolution is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this resolution.

SECTION 3. The provisions of this resolution shall become effective upon its passage, the public welfare requiring it.
